Case Overview
In the Spring 2025 semester, Redondo Union High School in California disciplined several students for comments they posted on the RUHS Swim Instagram account, joking about a graphic being difficult to read. In one case, the coach permanently suspended a student from the team, citing the Student Athlete Social Media Agreement and Athlete Code of Conduct, which mandate student athletes post only “positive things” and conduct themselves “at all times” in a “positive manner.” RUHS reversed the suspension, but the agreement and code remain in place.
On September 30, FIREwrote RUHS explaining that the agreement and code violate the First Amendment with vague and overbroad restrictions governing on- and off-campus student speech. FIREalso reminded RUHS that its authority to regulate off-campus speech is further diminished and that blocking accounts and deleting comments on school social media can amount to unconstitutional viewpoint discrimination.
