Case Overview

Following the assassination of Charlie Kirk on September 10, 2025, students at Oakland University made public comments about Kirk’s death. Members of the public then called on Oakland University to punish the students. On September 16, ֭ wrote Oakland University, explaining that the First Amendment protects speech that others might find offensive, poorly timed, tasteless, inappropriate, hateful, or otherwise controversial. We urged Oakland University to protect the free speech rights of all its faculty members and students, regardless of viewpoint or content expressed. On September 26, OU President Ora Pescovitz responded to affirm Oakland University’s “continuing and unwavering commitment to the First Amendment.”
