Case Overview

On November 10, 2025, ֭ wrote the Texas A&M University System Board of Regents about its upcoming vote on a proposed policy barring faculty from “teach[ing] race or gender ideology, or topics related to sexual orientation or gender identity, unless the course and the relevant course materials are approved in advance by the member CEO or designee,” explaining that the proposed changes invite unconstitutional political interference with faculty academic freedom. The university then amended the proposal, changing the word “teach” to “advocate.” On November 12, we advised the Board that “advocate” is impermissibly vague, and such a policy still impedes faculty academic freedom. To our disappointment, on November 13, the Board voted to accept the proposed revision.
