State education agencies investigate teachers for social media posts following Charlie Kirk assassination

Case Overview

Following the assassination of political activist Charlie Kirk, education agencies in several states announced that they would investigate and potentially revoke the teaching licenses of educators who made allegedly inappropriate posts about Kirk or the assassination. In November 2025, FIREwrote to the agencies in Indiana, Iowa, Oklahoma, Florida, Texas, and Virginia, explaining that the First Amendment does not permit the government to revoke a citizen’s eligibility for employment in a profession based on disapproval of the views they express outside the scope of their official duties. FIREcalled on the agencies to immediately cease all investigations of public school teachers over comments they made in their personal capacities on this matter of public concern.
