Case Overview

Democrats for an Informed Approach to Gender (DIAG) is a nonprofit group of current and former Democrats who believe the party’s stance on transgender issues is based on bad science and a flawed understanding of gender. The all-volunteer organization believes it offers a unique voice by explaining that the current Democratic consensus contradicts “” that the party espouses, like protecting women and supporting the scientific process. To advance its mission and political goals, DIAG wants to solicit charitable contributions in Illinois. The Supreme Court has placed charitable solicitation “.”&Բ;

But Illinois is enforcing a law that prevents DIAG from exercising First Amendment rights without prior approval. And DIAG cannot get Illinois’s approval because Illinois law contains the , which forbids nonprofits’ names from using words associated with established political parties—like the words “democrats” and “republicans”—unless the established party consents. In other words, the Party Name Provision requires DIAG to obtain a private actor’s permission before the government will allow DIAG to exercise its First Amendment right to solicit charitable contributions, creating a statutory scheme that violates the First and Fourteenth Amendments at every turn.

On January 27, 2026, FIREsued on DIAG’s behalf, seeking to block the Illinois Secretary of State from enforcing the Party Name Provision against DIAG or any other nonprofit.
